Service Agreement
This Plan Service Agreement (“Agreement”) is entered into by and among LT Trust Company, Inc. (LT Trust), a Colorado corporation with its principal offices at 1675 Broadway, Suite 500, Denver, CO 80202 and the “Employer” (as designated in the acknowledgment).
Among other services, LT Trust acts as a TPA and/or recordkeeper to qualified retirement plans. The Employer has adopted and is maintaining a qualified retirement plan (“Plan”) for the exclusive benefit of its employees. The Employer has designated a plan administrator (“Plan Administrator”) as the named fiduciary principally responsible for the administration of the Plan. Pursuant to the terms of this Agreement, LT Trust will perform specific services for the Plan as specified in the List of Services (“List of Services”), as elected by the Employer, for the fees specified in the Fee Schedule (“Fee Schedule”).
The parties hereto understand and intend that LT Trust shall not be a fiduciary within the meaning of the Employee Retirement Income Security Act of 1974 (“ERISA”) or any state law with respect to the Plan. LT Trust shall not have any discretion with respect to the management or administration of the Plan or with respect to establishing or changing any rules or policies pertaining to eligibility for or entitlement to benefits under the Plan. LT Trust shall not have any discretion, control or authority with respect to any assets of the Plan, including the investment or disposition thereof. All discretion and control with respect to the terms, administration, or assets of the Plan shall remain with the Employer or with the other named fiduciaries under the Plan (excluding LT Trust)
